This Privacy Policy describes the personal information that TLC Resources may collect from or about you, a person who interacts with TLC Resources on our website or through our mobile app, third party platforms or media, in person or otherwise. It also describes how we use, and to whom we disclose, that information. It is TLC Resources’ policy to comply with the privacy legislation within each jurisdiction in which we operate. Sometimes the privacy legislation or a person’s right to privacy are different from one jurisdiction to another. This Privacy Policy covers only those activities that are subject to the provisions of Canada’s federal and provincial privacy laws, as applicable. Consequently, the rights and obligations contained in this Privacy Policy may not be available to all persons or in all jurisdictions. Personal Information

For the purposes of this Privacy Policy, personal information is any information about an identifiable individual such as your name and e-mail address, but is not aggregated information that cannot be associated with a specific person. We do not knowingly collect personal information from persons under the age of 13 years except in accordance with our strict policies on information received from minor’s custodial parents and guardians.

How Personal Information is Collected

As a general rule, TLC Resources collects personal information directly from you. In circumstances where the personal information that we collect about you is held by a third party, we will obtain your permission before we seek out this information from such sources (such permission may be given directly by you or implied from your actions).

From time to time, we may use the services of third parties in our activities and operations and may also receive personal information collected by those third parties in the course of the performance of their services for us or otherwise.  Where this is the case, we will take reasonable steps to ensure that such third parties have represented to us that they have the right to disclose your personal information to us.

Where permitted or required by applicable law or regulatory requirements, we may collect information about you without your knowledge or consent.

Form of Personal Information Collected

We may collect information related to your visit to our website or use of our service including the through your participation in our products or services or through the internet protocol (“IP”) address and domain used to access our services and website. We may also be provided with the type and version of your browser, the website, portal or platform from which you came to access our services, the pages at which you entered and exited, affiliate log-in credentials, any website page that is viewed by that IP address and what country you are from. If you use a mobile device with location services enabled, we may collect and process information about your actual location through GPS signals, nearby Wi-Fi access points or cell towers. We use this information to monitor our services as well as website’s performance (such as number of visits, average time spent, page views) and for our business purposes.

In addition, we collect the personal information that you submit to us, such as your name, username, email address and any other contact or other information that you choose to provide by using the “contact us” portion of the website and mobile app.

Where you request information from us, we may use the e-mail address that you provide to send you information about offers on the services that we believe may be of interest to you. If you have asked us to put you on an e-mail mailing list to provide you with certain information on a regular basis, or if we send you information about our offers on products and services by e-mail, you may ask us to remove you from the list at any time (using the unsubscribe instructions provided with each e-mail and on our website).

Use of Cookies

When you visit our website or log in to the service, we place a “cookie” during the sign in process on the hard drive of your computer or device to track your visit. A cookie is a small data file that is transferred to your hard drive through your web browser and that can only be read by the website that placed the cookie on your hard drive. The cookie acts as an identification card and allows our website to identify you and to record your login status and preferences. The cookie allows us to track your visits to affiliate websites so that we can better understand your use of our service and so that we can customize and tailor the service to better meet your needs.

As we do not control the infrastructure of the internet, to facilitate the provisioning of services to you, TLC Resources may permit third-party companies to collect certain anonymous information when you visit our website or use our services. These companies may use non-personally identifiable information (e.g., click stream information, browser type, time and date, subject of advertisements clicked or scrolled over) during your visits to this and other websites in order to provide advertisements likely to be of greater interest to you. TLC Resources is not responsible for how such third parties collect, use or disclose your personal information. Purposes of Collecting Personal Information

Generally, TLC Resources collects personal information to enable us to undertake, manage and maintain our activities, improve our services and operations, including:

  • to establish, maintain and manage our relationship with you so that we may provide you with the services that have been requested;
  • to facilitate your request to engage the services of Cook Social Work Professional Corporation and related entities;
  •  
  • to be able to review the products and services that we provide to you so that we may understand your requirements for the targeted products and services and so that we and our partners may work to improve the products and services including by providing patches, fixes, bug corrections and other forms of updates and improvements;
  • for marketing and promotional purposes, including remarketing to our users about services or events that we think may be of interest to them;
  • to conduct research and provide reporting for internal and external clients;
  • to be able to comply with your requests;
  • to protect us against error, breach, fraud, theft and damage to our property;
  • to enable us to comply with all applicable laws or regulatory requirements; and

  • to comply with valid legal processes such as search warrants, summonses, or court orders;
  • to protect the rights and property of TLC Resources;
  • during emergency situations or where necessary to protect the safety of a person or group of persons;
  • if TLC Resources is acquired by or merged with another company. TLC Resources may disclose your information to satisfy any reasonable diligence required to effect a merger or acquisition without further notice;
  • where the personal information is publicly available; or
  • with your consent.

Consent

We collect, use or disclose your personal information where we have your consent to do so. Depending on the sensitivity of the personal information, your consent may be implied, deemed (using an opt-out mechanism) or express. Express consent can be given orally, electronically or in writing. Implied consent is consent that can reasonably be inferred from your action or inaction. When you enter into an agreement with us, we will assume your consent to the collection, use and disclosure of your personal information for purposes related to the performance of that agreement and for any other purposes identified to you at the relevant time.

Protection of Personal Information

TLC Resources endeavours to maintain physical, organizational, technical and procedural safeguards that are commercially appropriate to the sensitivity of the personal information in question. These safeguards are designed to prevent your personal information from loss or theft and unauthorized access, copying, use, modification or disclosure.

We kindly ask that you do not submit any sensitive personal information outside of secure channels. Please ask if you have any questions as to whether the channel in which you submit information is secure. If you are sending information to TLC Resources via email, please ensure the accuracy of our email address. If you wish to receive information from TLC Resources via email, please ensure the accuracy of your email address.

The information that you use and provide is your responsibility.

The information TLC Resources collects about you may be stored on or transmitted through servers outside your home country. If you are visiting our websites from a country other than Canada or your home country, please note that countries in which we may be hosting servers may not have the same data protection laws as your country or jurisdiction and that your personal information may be subject to access by law enforcement authorities in the jurisdiction in which your personal information is stored. By providing your personal information to TLC Resources, you are consenting to the use of your personal information for the uses described in this Privacy Policy and the potential transfer of your personal information to a country outside your home country.

When requesting access to your personal information, note that we may request specific information from you to enable us to confirm your identity and right to access, as well as to search for and provide you with, the personal information that we hold about you. We may charge you a fee to access your personal information; however, we will advise you of any fee in advance. If you require assistance in preparing your request, please contact the office of our Privacy Officer.

Your right to access the personal information that we hold about you is not absolute. There are instances where applicable law or regulatory requirements allow or require us to refuse to provide some or all of the personal information that we hold about you. In addition, the personal information may have been destroyed, erased or made anonymous in accordance with our record retention obligations and practices.

In the event that we cannot provide you with access to your personal information, we will endeavour to inform you of the reasons why, subject to any legal or regulatory restrictions.

From time to time, we may make changes to this Privacy Policy to reflect changes in its legal or regulatory obligations or in the manner in which we deal with your personal information. We post this Privacy Policy on our website and we encourage you to refer back to it on a regular basis.

Interpretation of this Privacy Policy

Any interpretation in an action, arbitration or otherwise associated with this Privacy Policy will be made by our Privacy Officer.

BEFORE USING THE TLC RESOURCES MOBILE APPLICATION, WEBSITE, OR OTHER TLC RESOURCES, YOU MUST ACKNOWLEDGE THAT YOU AGREE TO BE BOUND BY THESE TERMS OF SERVICE.

The website and mobile app are provided by 2621011 Ontario Inc. (“TLC Resources”). The website and mobile app provide general information and informative resources but are not a substitute for counselling services. Counselling services are provided directly by separate, qualified counsellors through a direct engagement by you with separate qualified providers with whom you will enter into further terms of service.

These terms of service govern your access to and use of TLC Resources’ mobile app, website and similar services (“Services”). Please read these Terms carefully and contact us if you have any questions. By signing up, accessing or using our Services, including registering for an account, you agree to be bound by these Terms and by our Privacy Policy.

TLC Resources (“we”, “our” “us” and terms of similar meaning) provides the TLC Resources mobile application and use of the TLC Resources website and any applications, mobile and touch versions and any individual sites or client-specific, city-specific, or other area-specific sites we have now or in the future (the “Site”), or other software provided by TLC Resources for use with the site or otherwise (altogether referred to as the “Services”) to you subject to these terms of service, as amended (these “Terms”).

The Services and Site are provided for your own personal use only. You may not resell, lease, assign or provide the Services, Site or any content contained therein in any other way to anyone else.

 Privacy Policy

TLC Resources’ Privacy Policy (available at https://www.familytlc.ca/practices-privacy-policy-page/) (the “Privacy Policy”) describes how we collect, use and disclose personally identifiable information and non-identifying aggregate information from Users of the Services. The Privacy Policy is expressly incorporated into these Terms. By using the Services, you agree to be bound to the provisions under the Privacy Policy.

TLC Resources provides informational services: TLC Resources does not provide counselling services

TLC Resources provides general information through its website and mobile applications. TLC Resources does not provide counselling services.  This information is not intended be relied upon as, or in replacement of, counselling services Clients seeking counselling services will be required to enter into separate counselling agreements with a qualified counsellor. If you wish to enter into a counselling services agreement, please contact Family TLC client services via phone at 705-315-0406 or by email clientservices@familytlc.ca. TLC Resources provides an intake form for submission to Family TLC. You may complete the applicable TLC Resources intake form through the website or mobile application and your information will be provided to Family TLC to determine whether Family TLC may provide these separate counselling services. 

 Submitting your information through the TLC Resources website or mobile application does not immediately create a counselling relationship with Family TLC. Family TLC client services will provide you with links to further documentation. Once you complete the forms, they will automatically be attached to your electronic file with Family TLC. You may continue to view and use the TLC Resources founds on our mobile app and website, subject to these Terms of Use and Privacy Policy, notwithstanding whether you enter into a counselling relationship with Family TLC.

Clients or prospective clients interested in viewing the resources available on the TLC Resources mobile application must first register through the mobile app. Registration is free and no initial purchase is required.

TLC Resources does not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to register for the Services. These Services are not generally directed to persons under 18. TLC Resources may provide services to persons under the age of majority through a separate process requiring the custodial parent or guardian to complete a separate questionnaire and application. In the event that we learn that we have collected personal information from a child under age 13 without verification of parental consent, we will remove that information as quickly as possible. If you believe that we might have any information from or about a child under 13, please contact us at clientservices@familytlc.ca with the subject line: “TLC Resources Inquiry”.

After registration, please advise TLC Resources immediately of any changes including name, address; telephone numbers and e-mail address by contacting us at  clientservices@familytlc.ca with the subject line “TLC Resources Account Update”.. If TLC Resources believes that some of its records are inaccurate, we may contact you to verify our records. TLC Resources reserves the right to refuse services to anyone it believes it has incomplete or inaccurate information.

You are solely responsible for ensuring that these Terms are in compliance with all laws, rules and regulations applicable to you and the right to access the Services is revoked where these Terms or use of the Services is prohibited and, in such circumstances, you agree not to use or access the Services in any way. You may not access or use the Site if we have previously banned you from the Site. You acknowledge that you will not use the information on our site to set up a similar or competing site or service.

Copyright and Trademarks Owned by Us

Other than the user content which we permit to be posted on our Site or Service, if any, the Site, Service, all content and all software or  program available on the Site and Service or used to create and operate the Site or Service, is the property of the TLC Resources or its licensors, and is protected by Canadian and international copyright laws, and all rights to the Site, such Content and such software are expressly reserved. Use of Family TLC’s copyright and trademarks on our website and mobile application are done so under license.

Other than user content, the Site, the TLC Resources logo and all other product or service names, slogans or logos displayed on the Site are registered or common law trademarks of TLC Resources or its licensors, and may not be copied, imitated or used, in whole or in part, without the prior written permission of TLC Resources or the applicable trademark holder. In addition, the look and feel of the Site, including all page headers, button icons, custom graphics and scripts may not be imitated, used or copied in whole or in part, without the prior written permission of TLC Resources.

Any copying, posting, transmitting, distributing, linking, deep linking, or otherwise modifying of the Services or without the express written permission of TLC Resources is strictly prohibited. Any violation of this policy may result in a copyright, trademark or other intellectual property right infringement that may subject user to civil and criminal penalties.

Intellectual Property of Vendors and Third-Parties

All other trademarks, company names, product names and logos mentioned on the Site are the property of their respective owners. Reference to any product, service, process or other information, by trade name, trademark, supplier, manufacturer or otherwise does not constitute or imply sponsorship, endorsement or recommendation thereof by TLC Resources. You acknowledge that you will not use any third party intellectual property rights in relation to the Services without the prior written consent of the appropriate holder of such rights. You represent and warrant that your use of the Site and the Content will be consistent with this license and will not infringe or violate the rights of any other party or breach any contract or legal duty to any other parties, or violate any applicable law.

Responsibility of User Content

We have no responsibility or liability for your user content or the user content of others on the Services, or for any loss or damage your user content may cause to other people. We are not obligated to make use of your user content and we may also remove or modify your user content at our absolute discretion at any time and for any reason.

User Content Must be Appropriate Content

By providing us content, you are providing TLC Resources a royalty-free, non-exclusive, worldwide, perpetual, irrevocable right and license to use, reproduce, perform, display, distribute, adapt, modify, re-format, create derivative works of, and otherwise commercially or non-commercially exploit in any manner, any and all of the content you provide on TLC Resources, and to sublicense the foregoing rights to our affiliates and partners for our uses including, but not limited to, promotional or market research purposes.

Availability of the Services or Site

You acknowledge that there may be interruptions in service or events that are beyond our control. While we use reasonable efforts to keep the Services and Site accessible and available, the Services or Site may be unavailable from time to time for any reason. You understand and acknowledge that due to circumstances both within and outside of our control, access may be interrupted, suspended or terminated. TLC Resources retains the right at our sole discretion to deny service, or access to the site to anyone or an account, at any time and for any reason.

Transmission of Information

Because we do not control the security of the Internet or other networks you use to access the Services, Site, or methods in which you communicate with us, we can’t be, and are not responsible for, the security of information, including personal information and financial data that you choose to communicate with TLC Resources and the Site while it is being transmitted. In addition, TLC Resources is not responsible for any data lost during transmission. TLC Resources does not accept financial data or conduct financial transactions on its site. TLC Resources will not require that such data is provided for use of the site. TLC Resources recommends reviewing the terms and conditions of any external site in which you engage in financial or private information sharing transactions.  

Accuracy of Information posted on the Site

TLC Resources does not represent or warrant that any information obtained via the Site, including information about any counselling services, product is accurate, error free or that it is up to date or relevant to you whatsoever. TLC Resources does not endorse, recommend, or guarantee any goods or services featured on the site or provided through the Services, and nothing will be considered an endorsement, recommendation, warranty or guarantee of the foregoing by TLC Resources.  

NO LIABILITY FOR CLAIMS

You waive and shall not assert any claims or allegations of any nature whatsoever against TLC Resources, its respective affiliates or subsidiaries, , contractors, licensors, advertisers, users or other partners, any of its successors or assigns, or any of their respective officers, directors, agents or employees or other related parties (collectively, the “Released Party”) arising out of or in any way relating to your use of the Services, Site or the content, including, without limitation, any claims or allegations relating to the alleged infringement of proprietary rights, alleged inaccuracy of content or counselling services, or allegations that any Released Party has or should indemnify, defend or hold harmless you or any third-party from any claim or allegation arising from your use or other exploitation of the Site. You use the Services at your own risk.

NO LIABILITY FOR DAMAGES

Without limiting the foregoing, neither TLC Resources nor any other Released Party shall be liable for any direct, special, indirect or consequential damages, or any other damages of any kind, including but not limited to loss of use, loss of profits or loss of data, whether in an action in contract, tort (including but not limited to negligence) or otherwise, arising out of or in any way connected with the Services, use of the Site or the Content, including without limitation any damages caused by or resulting from your reliance on the Site or other information obtained from TLC Resources or any other Released Party or accessible via the Site, or that result from mistakes, errors, omissions, interruptions, deletion of files or email, defects, viruses, delays in operation or transmission or any failure of performance, whether or not resulting from acts of God, communications failure, pandemic, theft, destruction or unauthorized access to TLC Resources or any other Released Party’s records, programs or services.

MAXIMUM LIABILITY

In no event shall the aggregate liability of TLC Resources, whether in contract, warranty, tort (including negligence, whether active, passive or imputed), product liability, strict liability or other theory, arising out of or relating to the use of the Services or Site exceed any fees paid by you during the three months prior to the date of the filing of any claim. You acknowledge that TLC Resources shall not be liable for any amounts if you had not paid any fees directly to TLC Resources.

Indemnity for Use of the Site

You shall defend, indemnify and hold harmless TLC Resources and the other Released Parties from any loss, damages, liabilities, costs, expenses, actions, claims and proceedings (including reasonable legal and experts’ fees and costs) arising out of or related to (i) any use or access by you (or on your behalf) of the Services or Site; (ii) any breach by you of any agreements, or representations and warranties contained in these Terms, (iii) any access to or use of the Service or Site by you in violation of any rights of TLC Resources or any third-party, including, but not limited to, copyright including moral rights, patent, trade secret, trademark, or other intellectual property rights and publicity and privacy rights, (iv) any access to or use of the website by you in violation of any applicable law, rule or regulation, or (v) any unauthorized access of, or through, the website to any computer system.

  • By posting a notice on www.familytlc.ca. It is your responsibility to review the Site for notices.

Receiving Information from TLC Resources

TLC Resources may send you printed or email information regarding your account status as well as marketing information we believe may be of interest to you including through remarketing. When you register for an account, you consent to receive all these types of information from us. However, you will be given the opportunity to opt-out of emails from TLC Resources by providing written notice to clientservices@familytlc.ca subject line “TLC Resources Opt-Out” .

Governing Law

You and TLC Resources explicitly agree that all disputes, claims or other matters arising from or relating to your use of the Site will be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein and attorn to jurisdiction of the courts within the Toronto region.

Method of Conflict Resolution

Except where prohibited by applicable law, any claim, dispute or controversy (whether in contract or tort, pursuant to statute or regulation, or otherwise, and whether pre-existing, present or future) arising out of or relating to (a) these Terms; (b) the Services, Site or Content; (c) oral or written statements, advertisements or promotions relating to these Terms or to the Site; or (d) the relationships that result from these Terms or the Site or Content (collectively, a “Claim”) will be referred to and determined by a sole arbitrator (to the exclusion of the courts excepting judicial review). If you have a Claim, you should give written notice to arbitrate at the email address specified below. All notices shall be delivered to your address provided by you on registration or as updated in writing. Arbitration will be conducted by one arbitrator pursuant to the commercial arbitration laws and rules in effect on the date of the notice in the Province of Ontario located in Toronto.  

Waiver of Future Class Action

Except where prohibited by applicable law, you waive any right you may have to commence or participate in any class action against TLC Resources related to any Claim and, where applicable, you also agree to opt out of any class proceedings against TLC Resources.

Compliance with Local Laws

If you choose to access the Site from locations other than Ontario, you will be responsible for compliance with all local laws of such other jurisdiction and you agree to indemnify TLC Resources and the other Released Parties for your failure to comply with any such laws.

Termination

Termination occurs when your account is terminated. You or TLC Resources may terminate your use of the Services at any time. TLC Resources maintains ethical practices and will not tolerate any misuse of our tools and resources by any person. If misuse occurs, we may immediately terminate the relationship and prevent any further misuse.

A TLC Resources client may terminate their account by providing written notice to clientservices@familytlc.ca subject line “Account Termination” . TLC Resources reserves the right to retain user information, including personal information, for its legal or business purposes, or converting such information in a non-aggregated or non-identifiable form, permanently.

If events beyond TLC Resources control materially affect TLC Resources ability to operate the TLC Resources Services, the Services may be suspended or terminated without notice.

Electronic Signature

Your affirmative act of registering for an account constitutes your electronic signature to the Terms of Service and your consent to enter into agreements with us electronically.

TLC Resources’ Right to Modify Terms

We reserve all rights to change or modify any of the terms and conditions contained in these Terms, any policy or guideline of the Services, any feature, or functionality, at any time and in our sole discretion, with or without notice. We may make changes to these Terms to reflect changes in legal or regulatory obligations or for our other business purposes. If you do not agree with the changes, you can cancel your account with us according to the termination provisions provided in these terms. Unless otherwise specified, any changes or modifications are effective immediately upon posting of the revisions on the website, and your continued use of the Services after such time constitutes your acceptance of such changes or modifications. We may notify you for material changes to these Terms, but you acknowledge that we are not obligated to do so. All issues and questions concerning the construction, validity, interpretation, and enforceability of the Program, or the rights and obligations of any User in connection with the Program, shall be governed by, and construed pursuant to the sole discretion of TLC Resources.

Severability

If any part of these Terms is considered invalid for whatever reason, the remaining parts of these Terms will still be considered valid and enforceable.

Assignment

User may not assign or transfer any or all of their rights without prior written consent of TLC Resources. TLC Resources may assign any or all of its rights hereunder to any party without your consent. These Terms will bind and inure to the benefit of the parties, their successors and permitted assigns.

Entire Agreement

These Terms, and the Privacy Policy expressly incorporated within, represent the entire Agreement between the Parties, and overrule any previous communications, understandings, between the parties.

Eazi-Business Ltd does not own any of the client data stored or processed via the service .

Eazi-Business Ltd is not responsible for the content of the personal data contained in the client data or other information stored on its servers.

At the discretion of the client or user nor is Eazi-Business Ltd responsible for the manner in which the client or user collects, handles disclosure, distributes or otherwise processes such information.

Access, Correction, Deletion 

We respect your privacy rights and provide you with reasonable access to the Personal Data that you may have provided through your use of the Services.

You may decline to share certain personal data with us, in which case we may not be able to provide to you some of the features and functionality of the Service.

Unless you want to use advanced features in applications, we do not require any form of registration, allowing you to use the application without telling us who you are.

However some services do require you to provide us with personal data.

In these situations, if you choose to withhold any personal data request by us, it may not not be possible for you to gain access to certain parts of the application and for us to respond to your query.

We use the information that we collect in a variety of ways in providing the service and operating our business.

to respond to comments and questions and to provide support to users of the service we process client data solely in accordance with the directions provided by the applicable client or user improvements.
- We may use a visitor or user email address or other information other than client data to contact that visitor or user for administrative purposes such as customer service,
to address intellectual property infringement, right of privacy violations or defamation issues related to the client data or personal data posted on the service.
